COL Robert C. Moscati, USA Retired

The firm’s founder and Principal, Rob Moscati, is a retired Army Colonel who served with distinction for 32 years in the Army Judge Advocate General’s Corps. This included stints with the 24th Infantry Division (Mech), 42nd Infantry Division (Mech), and United States Office of Military Commissions, Office of the Chief Prosecutor. COL (Ret.) Moscati also served under XVIII Airborne Corps, then, Multi-National Corps-Iraq, and the Office of the Secretary of Defense.

 

Early in his career, he served as a Brigade Trial Counsel, a U.S. Military Magistrate, the Chief of Military Justice, and the Deputy Staff Judge Advocate of the 42nd Infantry Division. Following the terrorist attacks of September 11, 2001, Rob immediately deployed to New York City, and was appointed the Command Judge Advocate of Task Force 42, the New York Army National Guard’s response to the destruction of the World Trade Center. A few years later, the Commanding General of the 42nd Infantry Division personally selected then Lieutenant Colonel Moscati to be the Division Staff Judge Advocate upon their deployment to Operation Iraqi Freedom. There, Rob was the principal legal advisor of Multi-National Division-North Central, a 23,000 person joint and combined arms task force headquartered in Tikrit, Iraq, and led the operations of over 85 legal personnel across 4 Iraqi provinces, including the Sunni Triangle. Rob’s 32 year military career culminated on active duty as the Deputy Chief Prosecutor of the United States Military Commissions, an office of more than 130 legal professionals responsible for the prosecution of Guantanamo Bay detainees such as Khalid Shaikh Mohammed (the leader of the 9/11 attacks), and Abd Al Rahim Al Nashiri (the mastermind of the USS Cole bombing), cases which represent the most significant and complex national security litigation ever conducted. Although the second-in-command in the office, Rob was dual-hatted by the Chief Prosecutor to also serve as the Lead Counsel of the Al Nashiri prosecution during an especially difficult period in that case. Mr. Moscati is the honored recipient of the Defense Superior Service Medal, the Legion of Merit, the Bronze Star, and citations from The President of the United States, two Governors of the State of New York, and the current Chairman of the Joint Chiefs of Staff.

 

COL (Ret.) Moscati’s military experience stands as a matter of great honor and pride to him. He is deeply aware of the courage and sacrifice of each and every one of his military friends and colleagues, and of all of the Soldiers, Sailors, Airmen, Marines and Coast Guardsmen who went before him defending our Country.
